Extent and purpose of the collection, processing and use of personal data

If you use the website without transmitting any other data to us (e.g. by registration or use of the contact form), we will only collect the technically required data, which are transmitted automatically to our server (e.g. IP address, date and time of the request, browser type and operating system). This is a technical requirement to allow us showing you our website. If personal data are affected in this context, Art. 6(1)(f) GDPR is the legal basis for the collection.

Newsletter and contact form

In order to receive the newsletter or to get in touch with us using the form, it is (*absolutely) essential that you enter the following personal data truthfully:

  • Your email address*
  • Title* (only with the newsletter registration)
  • Language* (only with the newsletter registration)
  • First name*
  • Surname*
  • Subject and message (only for contact form)

We require this information to process your requests, to be able to send you our newsletter and/or to use it for marketing purposes as described in more detail below.

The processing of your contact enquiry is our legal basis within the meaning of Art. 6 para. 1 lit. f EU-DSGVO. This legal basis allows the processing of personal data within the scope of our "legitimate interest". Our legitimate interest is to process your contact.
By registering for the newsletter, you consent to the processing of the data provided for the regular dispatch of the newsletter to the address you have provided. This consent constitutes our legal basis for the processing of your data within the meaning of Art. 6 para. 1 lit. a EU DSGVO.

Passing your data to third parties

We will only pass on your data if you have expressly consented for us to do so, we are obliged to do so by law or to the extent this is necessary to assert our rights.

In addition, we disclose personal information of users to third parties, to the extent necessary in the context of using the website, answering questions, processing inquiries or providing any services requested by the user. The use of this data by third parties is strictly limited to the purposes mentioned.

Newsletter

By registering for our newsletter, you expressly agree that we may use your mail address and personal data for our Newsletter. You may unsubscribe from the Newsletter at any time. You will find an unsubscribe link in all newsletter emails.

For the distribution of our newsletter, we use email marketing services (XCampaign) provided by Schober Information Group (Switzerland) AG, Theaterstrasse 17, 8400 Winterthur. The newsletter data is stored both on the website's hosting server and on a Schober server in Prague, Czech Republic.

Our newsletter may contain a so-called Web Beacon (tracking pixel) or similar technical means. A web beacon is a 1x1 pixel, non-visible graphic that is related to the user ID of each newsletter subscriber.

For each newsletter sent, there is information about the address file used, the subject and the number of newsletters sent. In addition, it can be seen which addresses have not yet received the newsletter, to which address it was sent and at which addresses the delivery failed. There is also the opening rate including the information as to which addresses have opened the newsletter. Finally, the information as to which addresses have unsubscribed. We use this data for statistical purposes and to optimise the content and structure of the newsletter. This allows us to better align the information and offers in our newsletter with the individual interests of the recipients. The tracking pixel is deleted when you delete the newsletter.
In order to prevent the use of the Web Beacon in our newsletter, if this is not already the case by default, please set your email programme so that no HTML is displayed in messages. On the following pages, you will find explanations on how to make this setting for the most common email programmes.

We base these data processing on Art. 6 para. 1 lit. f EU DSGVO. This legal basis allows the processing of personal data within the scope of our "legitimate interest". The legitimate interest lies in direct marketing and the analysis of the use of the newsletter.

Transmission of personal data abroad

Beyer is entitled to pass your data to third party companies abroad to the extent this is required in connection with the processing of your requests, the provision of services and marketing campaigns. These third-party companies are obliged to respect the privacy of users to the same extent as the provider itself. If the level of data protection in a country is considered unsuitable by Swiss standards or within the meaning of the EU General Data Protection Regulation, we will ensure, by means of a contract, that your personal data is protected according to Swiss regulations or the EU General Data Protection Regulation at all times.

An overview of third-party service providers and their locations can be downloaded here. Most service providers are located in Switzerland. However, some of the third-party service providers listed in this privacy policy are based in the USA (see “Tracking Tools” and “Social Media Functions”).

Right to information, deletion and correction

You may ask for information about your personal data stored by us at any time free of cost. Requests for information must be submitted in writing with proof of identity. You are also entitled to require that your data stored by us is deleted or corrected at any time.

We would like to point out that in the event that your data is deleted, our services cannot be used or can no longer be used in full. You can revoke your consent to certain data processing at any time with effect for the future.

Please note that certain data must be retained by us by law for a certain period. Such data must therefore remain stored by us until the end of this period. We will block this data in our system and only use it to comply with statutory requirements.

Advice for children and parents

Our website is aimed at an adult audience. It is forbidden for minors, and especially children under 13 years of age, to transmit personal data about themselves to us or to register to receive a service. If we detect that such data has been transmitted to us, it will be deleted from our database. The parents (or legal guardians) of the child may contact us and request deletion of the data or de-registration. For this purpose, we require a copy of an official document confirming you as a parent or guardian.

Data security

We use suitable technical and organisational security measures that seem appropriate to us to protect your data stored by us from manipulation, partial or total loss and unauthorised access by third parties. Our security measures are continuously updated according to technological developments.

We also take the protection of our own internal company data very seriously. Our staff and the service providers engaged by us are obliged to maintain confidentiality and to comply with the provisions of data protection law. Moreover, these are only granted access to personal data as far as is necessary.

Cookies

We use cookies to facilitate and improve the use of our website. Cookies are text information stored via the web browser on a computer at the visit of a website. The purpose is to recognize a visit, e.g. in case of a permanent login to a website or for the shopping cart function of an online shop.

Most of the web browsers accept cookies automatically. You may erase stored cookies at any time via the settings of your web browser. You may also adjust the settings of your web browser to bar the storing of cookies. Then, however, not all the functions of our website might be available.

Tracking tools

We use Google Analytics to analyse and improve the use of our website.

Google Analytics is a web analysis service of Google Inc. (“Google”). Google Analytics uses what is known as “cookies”, i.e. text files that are stored on your computer to allow an analysis of your use of the website. As a rule, the information on your use of the website generated by the cookie is transmitted to and stored on a server of Google in the USA. In the event of activation of the IP-anonymization on this website, however, your IP address will be truncated previously in member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is transferred to a server of Google in the USA and is truncated there. On the instruction of the operator of this website, Google will use this information to evaluate your use of the website in order to prepare reports on the website activities and to provide other services for the website operator relating to website use and internet use.

The IP address transmitted by your browser in the context of Google Analytics will not be combined with other data of Google.

You can prevent the storing of the cookies by an appropriate setting of your browser software; please note, however, that in this case you might not be able to use the full range of all functions of this website. Moreover, you can prevent the collection of the data (incl. your IP address) generated by the cookie and relating to your use of the website for Google as well as the processing of such data by Google by downloading and installing the browser plugin available at the following link:

We use Google Analytics with the extension “anonymizeIp()”. This is to truncate the IP addresses (so-called IP-masking). Thus, a connection to specific persons can be ruled out.

Google takes part in the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Framework. Accordingly, there is a reasonable data privacy level also in the exceptional cases in which Google transfers personal data to the USA.

The legal basis for the processing of data using Google Analytics is Art. 6(1) sentence 1(f) GDPR.

When you open a link to one of our social media profiles, a direct connection is established between your browser and the server of the relevant social network. This gives the network the information that you have visited our website with your IP address and accessed the link. If you access a link to a network while logged in to your account on the relevant network, the contents of our page may be linked to your profile in the network, which means that the network can link your visit to our website directly to your user account. If you want to prevent this, you should log out before clicking on the relevant links. An assignment takes place in any case, if you log into the relevant network after clicking on the link.

Storing Period

We process and store your data only for as long as it is required for the processing or for complying with statutory duties. Once the purpose of processing no longer exists, your data will be blocked or erased. If there are any additional statutory duties to store the data, we block or erase your data upon the lapse of the statutory storing periods.

You have the following statutory rights against us relating to your personal data:

  1. Right to be informed
    As the data subject (affected person), you have the right to request a confirmation on whether we process personal data relating to you. If this is the case, you have the right to be informed of such personal data as well as to further information, e.g. the purpose of processing, the recipient and the scheduled storing period or the criteria for the determination of such period, respectively.
  2. Right to rectification and completion
    As the data subject, you have the right to request the immediate rectification of incorrect data. Taking into consideration the purpose of processing, you have the right to request the completion of incomplete data.
  3. Right to erasure (“right to be forgotten”)
    As the data subject, you have the right to erasure if processing is not necessary. This is the case e.g. if your data are no longer required for the original purposes, if you withdrew your statement of consent relating to data privacy, or if the data have been processed unlawfully.
  4. Right to restriction of processing
    As the data subject, you also have the right to restriction of the processing if e.g. you think that the personal data would be incorrect.
  5. Right to data portability
    As the data subject, you have the right to receive your personal data in a structured, customary and machine-readable format.
  6. Right to object
    As the data subject, you have the right to raise objection against the processing of certain of your personal data at any time for reasons resulting from your situation.
    In case of direct marketing, you as the data subject have the right to raise objection against the processing of your personal data for the purpose of such marketing at any time; this also applies to the profiling associated with such direct marketing.
  7. Right to withdraw your consent relating to data privacy
    You may withdraw a consent to the processing of your personal data with effect in the future at any time. The legality of the processing made until such withdrawal, however, is not affected by the foregoing.
